Writing a Will, and thinking about our own death, is not the most pleasant of subjects and its easy to see why many people put it off for another day. If you have decided now is the time to write or update your Will here are some common mistakes to avoid.
1. Overpaying
We have seen a worrying increase in non regulated, often under qualified, Estate Planning/ Will writing companies. These companies may appear like law firms but look carefully! Many are uninsured and not covered by the Legal Ombudsman if you want to complain. They can often be seen outside supermarkets and on the high street selling their services. They usually offer home visits where they hard sell trusts, for eyewatering amounts of fees (£000s), which often cause more problems than they solve. If its too good to be true then it generally is!
2. Underpaying
Another worrying trend is for heavily discounted Groupon Wills and online services often costing less than £20. These companies, again often unregulated/ uninsured, often hide their fees as hidden extras for a later date. We have seen clients charged £15 a year for Will storage plus a £450 document retrieval fee when their loved one has died. Again these Wills are often poorly drafted and result in complex legal applications when the person has died to try and rectify errors.
